The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to June 2010. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

Contains information about amendments which have come into force between May to June 2010. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of June 2010 under which they were made (Governing Act).

Tetrachloroethylene (Use in Dry Cleaning and Reporting Requirements) Regulations (Canadian Environmental Protection Act, 1999): Proposed amendments are found in the Canada Gazette, Part I, May 22, 2010, p. 1335.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): Proposed amendments are found in the Canada Gazette, Part I, May 2, 2009, p. 1376. Proposed Amendment 9 regulations are found in the Canada Gazette, Part I, April 10, 2010, p. 840. Proposed changes are to harmonise with the United Nations' requirements for drums used in the transport of dangerous goods.

Vessel Operation Restriction Regulations (Canada Shipping Act, 2001): Proposed amendments are found in the Canada Gazette, Part I, May 1, 2010, p. 1082.

Wastewater Systems Effluent Regulations (Fisheries Act): Proposed regulations are found in the Canada Gazette, Part I, Mar. 20, 2010, p. 511.

Domestic Substances List (Canadian Environmental Protection Act, 1999): SOR/2010-82 adds 6 substances to Part 1, deletes one substance from Part 2, and adds 12 substances to Part 3.

Vehicle Inspection Regulation (Traffic Safety Act): Alta. Reg. 49/2010 replaces subsection 15 (1) regarding the sale of a used motor vehicle and s. 16 regarding the expiry of a dealer's mechanical fitness assessment.

Occupational Health and Safety Regulation (Workers Compensation Act): The new 2010 Proposed Amendments for Consultation are to be found on the Worksafe BC website. Consultation period ends 4:30 pm Friday, June 4, 2010.

Carbon Tax Act: S.B.C. 2010, c. 2 amends ss. 15, 18, 19, 28, 33, 38 and 59 by striking out references to propane. S.B.C. 2010, c. 5 repeals subsections 24(3) and (4).

Motor Vehicle Act: S.B.C. 2010, c. 5 amends ss. 3 and 17 by referencing several pieces of tax legislation.

Transportation Act: S.B.C. 2010, c. 5 repeals s. 35 regarding authority revenue from car rental taxes.

Emissions Offsets Regulation (Greenhouse Gas Reduction Targets Act): B.C. Reg. 393/2008 repeals the definition of "qualified professional" and replacing the definition of "validation body" and "verification body".

Territorial Parks Regulations (Territorial Parks Act): R-036-2010 adds 30.3(1)(e) and replaces item 5(b) in schedule D regarding extended stay campsite permits for Reid Lake Territorial Park.

Motor Vehicle Act: S.N.S. 2010, c. 20 makes several amendments regarding the issuance and administration of driver's licences for participants of an alcohol ignition interlock program.

Building Code Act, 1992: S.O. 2009, c. 33, Sch. 21 repeals s. 9 and paragraph 34(1)6. Clause 36(1)(c) and subsection 36(8) are replaced.

Planning Act: S.O. 2009, c. 33, Sch. 21 adds subsection 51(3.1) and amends subsection 51(11) to reflect the change.

Technical Standards and Safety Act, 2000: S.O. 2010, c. 28 makes several amendments. These include the addition of ss. 3.1 - 3.24 which make the Technical Standards and Safety Authority a statutory corporation under the Act and further outline the roles and structure of the Authority. Further amendments are made regarding safety measures taken with respect to an imminent hazard and adding regulation-making powers.

Classification of Proposals for Instruments (Environmental Bill of Rights, 1993): O. Reg. 160/10 makes several amendments that prescribe certain instruments under the Safe Drinking Water Act, 2002 as well as under the Endangered Species Act, 2007. It updates the responsibility for issuing instruments under the Crown Forest Sustainability Act, 1994, from MNR to the Ministry of Northern Development, Mines and Forestry (MNDMF) and incorporates updated references to the Gasoline Handling Code and the Ministry of Consumer and Business Services Act for the Ministry of Consumer Services (MCS).

Conservation Reserves: General Provisions (Provincial Parks and Conservation Reserves Act): O. Reg. 167/10 amends the definition of "disabled person".

Drinking-Water Systems (Safe Drinking Water Act, 2002): O. Reg. 106/10 repeals clauses 1(1)(d)-(f) and replaces them with clause (d) referencing the Long-Term Care Homes Act, 2007.

General (Clean Water Act, 2006): O. Reg. 59/10 adds s. 12 regarding drinking water systems prescribed for the purpose of subclause 15(2)(e)(iv) of the Act.

General (Smoke-Free Ontario Act): O. Reg. 96/10 repeals paragraphs 12(4)-(6) and replaces them with paragraph 4 referencing the Long-Term Care Homes Act, 2007.

General (Application of Act) (Environmental Bill of Rights, 1993): O. Reg. 159/10 makes amendments prescribing the Lake Simcoe Protection Act, 2008 and the Toxics Reduction Act, 2009 for MOE; as well as the Food Safety and Quality Act, 2001 for the Ministry of Agriculture, Food and Rural Affairs (OMAFRA).

General Regulation (Workplace Safety and Insurance Act, 1997): O. Reg. 80/10 amends Class H of Schedule 1.

Health Care and Residential Facilities (Occupational Health and Safety Act): O. Reg. 94/10 repeals paragraphs 2(1)5-7 and replaces them with paragraph 5 referencing the Long-Term Care Homes Act, 2007.

Hospital Management (Public Hospitals Act): O. Reg. 156/10 replaces subsection 2(4) and adds subsection 2(5.1) regarding the establishment of a system for disclosure and risk mitigation of critical incidents.

Needle Safety (Occupational Health and Safety Act): O. Reg. 317/08 replaces paragraphs 7-9 of s. 2. O. Reg. 439/09 replaces all of s. 2 and amends paragraph 5(1)1.

Provincial Parks: General Provisions (Provincial Parks and Conservation Reserves Act): O. Reg. 85/10 replaces clause 23(2)(a) referencing the Long-Term Care Homes Act, 2007. O. Reg. 165/10 amends the definitions of "disabled person" and "provincial park permit".

Regulation to amend the Regulation respecting exemptions from the application of Title VIII.1 of the Highway Safety Code (Highway Safety Code): Draft amendments are found in the Gazette officielle du Quebec, Dec. 16, 2009, p. 4133.

Regulation to amend the Regulation respecting mandatory reporting of certain emissions of contaminants into the atmosphere (Environment Quality Act): Proposed amendments are found in the Gazette officielle du Qu�bec, June 9, 2010, p. 1398. The purpose of the draft Regulation is to make the reporting of greenhouse gas emissions compulsory.

Regulation to amend the Regulation respecting pits and quarries (Environment Quality Act): Proposed regulation is found in the Gazette officielle du Qu�bec, May 20, 2009, p. 1726.

Reservoir Development Area Regulations (Saskatchewan Watershed Authority Act, 2005): Sask.
